MyCircle — Terms of Service

These Terms of Service ("Terms") form a binding legal agreement between you ("you", "user") and Rui Almeida, a sole individual operator based in Portugal, trading as MyCircle ("MyCircle", "we", "us", "our"). MyCircle is a mobile application that helps users discover nearby people, content, and local events.

By creating an account, accessing, or using MyCircle, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the app.


1. Who we are

MyCircle is operated by an individual natural person established in Portugal. For all purposes under these Terms and under EU law (including the GDPR), the operator and data controller is:

We are not a registered company. MyCircle is operated as an independent personal project by a single natural person.


2. Eligibility — you must be 18 or older

MyCircle is strictly for adults. By creating an account you represent and warrant that:

We reserve the right to request proof of age at any time and to suspend or permanently delete any account we reasonably believe belongs to a minor or to a person who provided false eligibility information. Accounts created in violation of this section will be deleted without notice and without refund.


3. Your account

3.1 Registration

To use MyCircle you must create an account using a valid email address, Google Sign-In, or Apple Sign-In. You agree to provide accurate information, including a real first name or chosen display name, your date of birth, and your approximate location.

3.2 Account security

You are solely responsible for keeping your login credentials confidential and for all activity that happens through your account. Notify us immediately at mycircle.app.2026@gmail.com if you suspect unauthorised use. We are not liable for losses arising from your failure to secure your account.

3.3 One account per person

You may not maintain more than one personal account, share your account with others, or create an account on behalf of another person without their explicit authorisation.

3.4 Username and display name

Your username (@handle) and display name are visible to other users. You agree not to use a name that is offensive, impersonates another person, infringes a trademark, or violates any law. We may rename or reclaim usernames at our discretion, with or without notice.


4. Licence to use the app

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use MyCircle on a mobile device that you own or control, solely for your personal, non-commercial use.

You may not:

All intellectual property rights in the app, including its design, code, brand, name, logo, and any associated content we create, remain with us. Nothing in these Terms transfers ownership of any of those rights to you.


5. User-generated content

5.1 You own your content

You retain ownership of the photos, videos, captions, messages, comments, and other content you post on MyCircle ("Your Content"). MyCircle does not claim ownership of Your Content.

5.2 The licence you grant us

By posting, uploading, or transmitting Your Content through MyCircle, you grant us a worldwide, royalty-free, sublicensable, transferable, non-exclusive licence to host, store, cache, reproduce, adapt, publish, translate, distribute, publicly display, and publicly perform Your Content strictly for the purposes of operating, providing, improving, marketing, and securing the MyCircle service, including:

This licence ends when you delete Your Content or your account, except to the extent that (a) we are legally required to retain it (e.g., to respond to a court order or law-enforcement request), (b) it has been shared with other users who have downloaded or saved a copy, or (c) anonymised analytics derived from it persist in our records.

5.3 Your representations about Your Content

You represent and warrant, for each item of Your Content you post, that:

You are solely and fully responsible for Your Content and for any consequences of posting it. We do not pre-screen content before publication, although we use automated moderation tools (see §7).


6. Acceptable use — what you may not do

You agree not to do, attempt, or encourage any of the following, on the app or in connection with it:

Violations may result in immediate content removal, account suspension, account deletion, and, where appropriate, reports to law-enforcement authorities. We may also pursue civil remedies. You agree to indemnify us in accordance with §13 for any third-party claim arising from your violation of this section.


7. Content moderation — automated and human

7.1 Automated moderation

Every image and video uploaded to MyCircle is automatically scanned by a third-party content-classification system (currently Google Cloud Vision SafeSearch) before being shown to other users. Content classified as likely adult, violent, sexual, or otherwise prohibited may be automatically rejected, hidden, and permanently deleted, with the author notified through an in-app notification.

7.2 Community reporting

Any user can report another user, post, Moment, message, or Circle. Reports are reviewed by the operator. Content that receives multiple reports may be automatically hidden pending review.

7.3 Our enforcement discretion

We may remove content, suspend accounts, or permanently delete accounts at our sole discretion, with or without notice, for any reason we reasonably believe protects the safety of the community or the integrity of the service. We are not obligated to monitor content, to review every report, or to enforce uniformly across the platform. Decisions to remove or retain content are taken case-by-case and do not create any obligation or expectation regarding similar future content.

7.4 Appeals

If your content is removed or your account suspended, you may appeal by writing to mycircle.app.2026@gmail.com. We will review appeals in good faith but make no guarantee of reinstatement.


8. Location services

MyCircle's core features depend on your device location:

You acknowledge that broadcasting your location to other users may carry safety risks. You alone decide what radius to use, what content to make public versus friends-only, and which users you interact with in person. See §11 for our liability disclaimer regarding in-person meetings and any harm arising from them. Full details on location processing are in our Privacy Policy.


9. Third-party ticket sales — IMPORTANT DISCLAIMER

MyCircle displays event listings sourced from third-party ticketing partners, currently including SeatGeek, TicketNetwork, StubHub, and viagogo (collectively, "Ticketing Partners"). When you tap "Buy Tickets" or any similar call-to-action, you leave MyCircle and are taken to the Ticketing Partner's website or app, where the entire purchase is conducted.

You expressly acknowledge and agree that:

  1. We do not sell tickets. MyCircle is not a ticket vendor, a ticket reseller, a ticket broker, or an agent for any Ticketing Partner. We have no inventory, no control over pricing, no control over availability, and no control over fulfilment.
  2. The entire transaction is between you and the Ticketing Partner. This includes, without limitation: payment processing, ticket delivery, ticket authenticity, ticket validity, event entry, refunds, cancellations, rescheduling, name changes, transfer rights, taxes, fees, and any disputes whatsoever.
  3. We earn an affiliate commission when you complete a purchase through certain links. This is disclosed in the app. The commission is paid by the Ticketing Partner and does not increase the price you pay.
  4. We make no representations or warranties about any Ticketing Partner, any event, any ticket, any seller, any venue, any performer, or any aspect of the ticket purchase. Listings shown in MyCircle, including titles, dates, venues, prices, performer images, and availability, are provided by third parties and may be inaccurate, outdated, mislabelled, or withdrawn at any time without notice.
  5. All complaints, refund requests, ticket failures, fraudulent listings, scalping disputes, event cancellations, and any other issues related to a ticket purchase must be raised directly with the Ticketing Partner through the contact channels they provide on their own platform. We have no authority and no obligation to intervene, mediate, refund, replace, compensate, investigate, or otherwise act on any ticket-related complaint.
  6. You are responsible for reviewing and accepting the terms of service, purchase terms, and privacy policy of any Ticketing Partner before completing a transaction. By following an affiliate link, you leave MyCircle's jurisdiction and enter the Ticketing Partner's.
  7. To the maximum extent permitted by law, we disclaim all liability of any nature — direct, indirect, incidental, special, consequential, punitive, or otherwise — arising out of or related to any ticket purchase, any event you attended or failed to attend, any ticket that proved invalid or fraudulent, or any interaction with a Ticketing Partner.

This disclaimer also applies to advertisements served through Google AdMob and to any other third-party offer, link, or content that may appear in the app from time to time.


10. Third-party services and links

In addition to Ticketing Partners, the app integrates the following third-party services, each governed by its own terms and privacy policy:

You acknowledge that we are not responsible for the acts, omissions, content, accuracy, availability, or security of any third-party service. Your interaction with any third-party service is governed by that party's own terms.


11. Disclaimer of warranties

The app and the service are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by mandatory applicable law, we disclaim all warranties, including but not limited to: merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, uninterrupted operation, error-free operation, security of data, freedom from viruses, and that any defect will be corrected.

We make no warranty that:

You acknowledge that MyCircle is a social-discovery tool and that interactions facilitated by the app — including in-person meetings with other users — carry inherent risks. We do not conduct background checks on users. We do not verify identities. We do not guarantee that any user is who they claim to be. You are solely responsible for the choices you make about whom to meet, where to meet, and how to interact. We strongly recommend that you meet new people in public places, tell a trusted contact about your plans, and exercise the same caution you would in any setting where you meet strangers.


12. Limitation of liability

To the maximum extent permitted by applicable law:

(a) In no event will we be liable to you or to any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, loss of business opportunity, business interruption, personal injury, emotional distress, or property damage, arising out of or related to your use of, or inability to use, MyCircle, even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.

(b) Our total aggregate liability for all claims arising out of or related to these Terms or to MyCircle, whether in contract, tort (including negligence), strict liability, statute, or otherwise, will not exceed the greater of (i) the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (ii) fifty euros (€50). Because MyCircle is currently free to use, this cap will typically be €50.

(c) We have no liability whatsoever for:

(d) Mandatory consumer law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law in your country of residence, including, for consumers in the European Union, liability for death or personal injury caused by gross negligence or intent.


13. Indemnification

You agree to defend, indemnify, and hold harmless the operator (Rui Almeida) and any person acting on his behalf from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

We reserve the right to assume the exclusive defence and control of any matter for which you are required to indemnify us, in which case you agree to cooperate with our defence.


14. Account termination and the right to be forgotten

14.1 You can leave at any time

You may delete your account and all associated personal data at any time, with no friction and no questions asked, by going to Settings → Account → Delete account inside the app and typing "DELETE" in the confirmation field.

When you confirm deletion, we immediately and permanently:

This process is irreversible. We do not keep a "deleted but recoverable" copy of your account.

You may also remove the app from your device at any time through your device's standard uninstall flow. Uninstalling alone does not delete your account — to fully exercise your right to erasure, please use the in-app delete flow described above, or email us (see §14.4).

14.2 Data export (right to data portability)

Before deleting your account — or at any other time — you can download a machine-readable copy of your personal data via Settings → Privacy → Export my data. We will email you (or expose in-app) a secure, time-limited download link containing a JSON file of your personal data across the relevant tables in our database.

14.3 Termination by us

We may suspend or terminate your access to MyCircle at any time, with or without notice and with or without cause, including (without limitation) if we reasonably believe you have violated these Terms, harmed another user, exposed us to legal risk, or abused the service. Upon termination, your right to use the app ceases immediately, but the provisions of these Terms that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will continue to apply.

14.4 How to reach us about your data

If for any reason the in-app deletion flow is unavailable to you, or if you wish to exercise any other data-protection right, email mycircle.app.2026@gmail.com with the email address tied to your account. We will respond within thirty (30) days, as required by Article 12(3) GDPR.


15. Changes to the service and to these Terms

We may modify, suspend, or discontinue any part of MyCircle at any time, in whole or in part, without notice and without liability to you.

We may update these Terms from time to time. The most current version is always published at https://mycircle-page.vercel.app/terms, with a "Last updated" date at the top.

For any material change, we will:

We will not enforce a material change until at least thirty (30) days after the updated version is published on our website, unless the change is required by law or addresses a security issue, in which case it may take effect immediately.

We encourage you to review the current version periodically. Continued use of the app after the effective date of an update means you accept the updated Terms. If you do not accept them, your remedy is to delete your account under §14 before the effective date.


16. App-store-specific terms

16.1 Apple App Store

If you downloaded MyCircle from the Apple App Store, you acknowledge that these Terms are between you and us, not between you and Apple. Apple is not responsible for MyCircle or its content. Apple has no obligation to provide support or to handle warranty claims; any product-liability claim, IP claim, or regulatory issue regarding MyCircle is our responsibility, not Apple's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16.2 Google Play Store

If you downloaded MyCircle from Google Play, you agree to comply with the Google Play Terms of Service in addition to these Terms.


17. Governing law and dispute resolution

17.1 Governing law

These Terms and any dispute arising out of or related to them or to your use of MyCircle are governed by the laws of Portugal, without regard to its conflict-of-laws principles. For consumers resident in the European Union, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of your country of habitual residence.

17.2 Jurisdiction

You and we agree that any dispute, controversy, or claim arising out of or related to these Terms or to MyCircle will be submitted to the exclusive jurisdiction of the courts of Santa Maria da Feira, Portugal, except where mandatory law gives a consumer the right to bring proceedings in the courts of their country of habitual residence, in which case that right is preserved.

17.3 Online dispute resolution (EU consumers)

If you are a consumer resident in the European Union, you have the right to use the European Commission's online dispute-resolution platform, available at https://ec.europa.eu/consumers/odr. However, we are not obliged and do not commit to use any alternative dispute-resolution body to resolve disputes with consumers.

17.4 Time bar

Any claim against us must be filed within one (1) year of the event giving rise to it, or it is permanently barred, except where mandatory law provides a longer period that cannot be reduced by contract.


18. Miscellaneous

By using MyCircle you confirm that you have read and understood these Terms and that you agree to be bound by them.
